Agreement to Terms
By creating an account or using ProductPen, you agree to these Terms of Service. If you do not agree, please do not use the service.
These terms apply to all users, including free and paid accounts. We may update these terms with notice (see Section 10).
What ProductPen Is
ProductPen is an AI-powered product description generator for e-commerce sellers. We provide tools to:
- Generate new product descriptions
- Improve existing descriptions
- Audit descriptions (score 0–100)
- A/B test description variants
- Generate descriptions in bulk via CSV
- Create narrative-style descriptions (Story Mode)
The service is provided "as is." While we strive for high-quality AI outputs, we cannot guarantee that generated descriptions will be perfectly accurate, error-free, or suitable for every situation.
Your Account
Account creation
- You must provide accurate, current information when creating your account
- You must be at least 16 years old to use ProductPen
- One account per person — shared accounts are not permitted
Account security
- You are responsible for maintaining the security of your password
- You are responsible for all activity under your account
- Notify us immediately at support@productpen.xyz if you suspect unauthorized access
Account termination
We reserve the right to suspend or terminate accounts that:
- Violate these terms
- Are used for fraudulent or illegal purposes
- Generate content that is harmful, deceptive, or violates third-party rights
- Systematically abuse the service or circumvent usage limits
Acceptable Use
You agree not to:
- Generate content that is illegal, harmful, deceptive, or discriminatory
- Use ProductPen to create misleading product claims
- Spam, scrape, or systematically abuse the service
- Circumvent usage limits or access controls
- Reverse-engineer, copy, or redistribute the underlying AI models
- Resell or sublicense access to the service
- Use automated tools to access ProductPen without permission
Content Ownership
Your content
You retain full ownership of:
- Product details and information you provide
- Descriptions generated by ProductPen based on your inputs
- Any content you upload (CSV files, existing descriptions)
Our license
By using ProductPen, you grant us a limited license to process your content solely to deliver the service. This includes:
- Sending your product details to our AI provider for generation
- Storing your generated descriptions in your account
- Displaying your content back to you in the dashboard
We do not claim ownership of your generated content.
Plans, Payments, and Refunds
Plans
Billing
- Paid plans are billed monthly or annually via Stripe
- Prices are in USD and do not include applicable taxes
- We reserve the right to change pricing with 30 days' notice
Cancellation
- You may cancel your subscription at any time
- After cancellation, you retain access until the end of the current billing period
- No partial refunds for unused time within a billing period
Refunds
- Payments are generally non-refundable
- If you experience a significant service issue, contact support@productpen.xyz within 14 days for review
- We handle refund requests on a case-by-case basis
Credits
- Free and Starter credits do not roll over between months
- Unused credits expire at the end of each billing cycle
- Credits cannot be transferred between accounts
Service Availability
We strive for 99.9% uptime but do not guarantee uninterrupted service. ProductPen may be temporarily unavailable due to:
- Scheduled maintenance (we will provide notice when possible)
- Unplanned outages or technical issues
- Factors beyond our control
We are not liable for any losses resulting from service interruptions.
Limitation of Liability
To the maximum extent permitted by law:
- ProductPen is provided without warranty of any kind
- We are not liable for indirect, incidental, or consequential damages arising from your use of the service
- Our total liability shall not exceed the amount you paid to ProductPen in the 12 months preceding the claim
This includes but is not limited to:
- Losses from inaccurate AI-generated descriptions
- Lost sales or revenue from product listings
- Data loss due to service interruptions
- Damages from unauthorized access to your account
Intellectual Property
Our intellectual property
ProductPen, its logo, design, and underlying technology are owned by us and protected by intellectual property laws. You may not copy, modify, or redistribute any part of the ProductPen service.
Feedback
If you provide feedback, suggestions, or ideas about ProductPen, we may use them to improve the service without obligation or compensation.
Changes to Terms
We may update these terms from time to time. When we do:
- We will notify you via email for significant changes
- We will update the "Last updated" date at the top
- Continued use after 30 days constitutes acceptance
If you disagree with updated terms, you may close your account before they take effect.
Governing Law
These terms are governed by applicable law. Any disputes will be resolved through good-faith negotiation first. If necessary, disputes will be resolved through binding arbitration.
